Accommodation contract

An accommodation contract governs the paid lodging of a guest and the services agreed with the accommodation provider.

An accommodation contract is the agreement between an accommodation provider and a guest for paid lodging and the additional services agreed between them. Depending on the booking, these may include meals, cleaning, wellness services or other hotel services. The period of stay, price and specifically agreed scope of services are particularly important.

Accommodation can create statutory duties in addition to the contractual obligations. Section 970 of the Austrian General Civil Code (ABGB) contains a specific liability rule for innkeepers in relation to property brought in by guests. Whether liability exists and how far it extends depends on the statutory requirements and the circumstances of the individual case.
