When package travel may be involved
The Austrian Package Travel Act generally concerns the combination of at least two different travel services for the same trip or holiday. Typical services include carriage, accommodation, car rental and another tourist service. The offer, selection, booking time, total price and payment flow must be considered together.
Distinguishing package travel from linked arrangements
Where further services are arranged after an initial booking, the result may be a linked travel arrangement rather than package travel. The sequence of the bookings, the information shown during the process and the identity of each contracting party matter. A later service does not become package travel merely because it is offered on the same website.
The role of the travel organiser
For package travel, the organiser is responsible for the agreed travel services even where a hotel, transfer company or excursion provider performs the service. The booking confirmation, travel terms, legal notice and correspondence are more useful than the company name alone. An intermediary and an organiser do not have the same legal role.
What to record when a service differs
A departure from the contract should be reported as soon as reasonably possible and described precisely. State which promised service is missing or different, when you noticed it and what remedy was offered. A price reduction, damages or further remedies depend on the service, the effect on the trip and the statutory requirements. A general percentage would therefore give a false impression of precision.
Does a hotel and flight always amount to package travel?
No. The important question is how the two services were connected and booked for the same trip. A joint offer, one total price or a particular booking sequence may matter. The documents should show what actually happened.
Who should be contacted about a travel problem?
That depends on the contractual role and booking structure. For package travel, the organiser or the contact point named in the documents should be informed as soon as possible. A notice to an intermediary may also matter under the Package Travel Act.
Can the check calculate a price reduction?
No. The amount depends on factors such as duration, importance and effect of the departure and on the particular travel service. The check only classifies the booking structure and the documents needed for the next step.
